These terms apply when you use the PATS Gems website, make a booking, visit our premises, participate in a fossicking experience or purchase goods or services from us. Pats Sapphire Central provides visitor fossicking experiences, gemstone guidance, café services and retail products at 1056 Rubyvale Road, Sapphire Central QLD 4702.
2. Website information
We take reasonable care to keep website information accurate and current. Images, descriptions, availability, operating hours and prices may change. Website content is general information and is not professional geological, valuation, financial or legal advice.
3. Bookings
- A request is confirmed only when we accept it and provide confirmation.
- You must provide accurate contact details, visitor numbers and information reasonably needed to arrange the experience.
- Children must be supervised by a responsible adult at all times.
- Additional written terms may apply to group, school, private or special-event bookings.
- Changes and refunds are governed by our Cancellation & Refund Policy.
4. Prices and payment
Prices are in Australian dollars and include GST where applicable. Additional charges will be disclosed before you agree to pay. We may correct an obvious pricing or description error before accepting an order or booking. Payment must be made using an accepted method.
5. Participation, safety and accessibility
Fossicking is a hands-on outdoor activity involving soil, gravel, water, tools, uneven surfaces and changing weather.
- Follow staff instructions, signs and safety directions.
- Use equipment only as instructed and wear suitable clothing and footwear.
- Supervise children and anyone in your care.
- Tell us about accessibility needs or relevant limitations so reasonable arrangements can be discussed.
- Avoid conduct that risks injury, damages property or disrupts others.
We may modify, pause or refuse participation where reasonably necessary for safety, lawful operation or the comfort of others.
6. Gemstone finds and valuations
Gemstone finds vary naturally. We do not guarantee a sapphire or stone of any particular type, size, quality or value. Informal comments about a stone are opinions unless we expressly provide a separate written valuation service. Unless staff advise otherwise, visitors may keep stones found in material supplied as part of their paid experience.
7. Visitor property and conduct
Please take reasonable care of your belongings. To the extent permitted by law, PATS Gems is not responsible for loss or damage not caused by our act or omission. Visitors are responsible for damage they deliberately or negligently cause. We may ask a person to leave for unsafe, unlawful, abusive or seriously disruptive conduct.
8. Retail, café and gift vouchers
Natural gemstones and handmade items may vary in appearance. Visitors with allergies or dietary requirements must speak with staff before ordering; we cannot promise an entirely allergen-free environment. Returns and remedies are handled under our Cancellation & Refund Policy and consumer law.
Gift cards and vouchers are subject to their displayed conditions and statutory minimum expiry periods unless legally exempt.
9. Photography and intellectual property
Personal photography is welcome where safe and respectful. Commercial filming or drone use requires written permission. We will seek appropriate permission before using an identifiable visitor’s image for marketing, including parent or guardian permission for a child.
Our website, branding, text, graphics and photographs are protected. Reasonable personal use is allowed, but content must not be reproduced, sold, republished or commercially exploited without permission.
10. Third-party services
Our website may link to booking, payment, mapping, social-media or other third-party services with their own terms and privacy practices. We are not responsible for third-party content or systems, subject to responsibilities that cannot lawfully be excluded.
11. Consumer guarantees and liability
Our goods and services come with consumer guarantees that cannot be excluded. Depending on the circumstances, available remedies may include repair, replacement, refund, repeat performance, cancellation or compensation.
To the extent permitted by law, PATS Gems is not liable for indirect or consequential loss that was not reasonably foreseeable or caused by our breach, negligence or unlawful conduct.

Weather, emergencies, road closures, utility failures or other events outside reasonable control may affect services. We will take reasonable steps to notify affected customers and provide an appropriate solution where a paid service cannot be supplied.
13. Privacy, changes and governing law
We handle personal information under our Privacy Policy. We may update these terms, but the terms applying to an accepted booking or completed purchase are those in effect when the agreement was made unless a change is required by law or agreed with you.
These terms are governed by Queensland law. The parties submit to the courts of Queensland and courts entitled to hear appeals from them.
